Life Sciences and Biotechnology

  Morgan & Finnegan broke ground in 1980, becoming one of the first law firms to establish a biotechnology practice group. Twenty five years and a scientific revolution later, we have one of the most experienced life science and biotechnology practices of any American law firm, with a full compliment of Ph.D. attorneys and scientific advisors. We represent an array of the top research institutions and universities, major pharmaceutical companies, venture capital interests, start-up companies and individuals around the world.

Comprising partners, associates and advisors with advanced degrees and technical backgrounds, we draw on this expertise for a wide range of discoveries that affect agriculture, forensic science and medicine, such as transgenic mammals, gene cloning techniques and monoclonal antibodies.

Our opinion work in the areas of validity, infringement, enforceability, due-diligence and freedom of use is consistently of the highest quality. Biotechnology, like many industries today, changes its face rapidly, so we are frequently asked to advise our clients and negotiate on their behalf with regard to acquisitions, mergers and matters of licensing.

Our practice is global, and the particular technologies in which we specialize include immunology, vaccines, neurobiology, growth, growth factors, protein expression, PCR, lipid-based drug delivery systems, gene therapy, phage display and microarrays, just to name a few.

Morgan & Finnegan has played a substantive role in the biotechnology and life sciences arena for many years. We successfully defended Chugai Pharmaceutical, Ltd. in a proceeding that significantly affected the role and jurisdiction of the U.S. International Trade Commission with respect to biotechnology. In Genentech v. Novo Nordisk, we successfully defended our client in another landmark case that defined what information was required to patent a biotechnology invention and clarified standards.

We have been involved in a number of large-award patent cases in the biotechnology area, including litigations related to erythropoietin, GCSF, Factor VIII and Pertussis Toxin. The most prominent of these engagements was as lead trial counsel for The Scripps Research Institute and Rhone-Poulenc Rorer, Inc. in the decade-long, internationally cited Factor VIII litigations that led to settlement after trial in excess of $150 million.
