Morgan & Finnegan is in the forefront of law firms representing companies in the chemical industry. Our long and distinguished involvement with clients in this sector gives us an intimate understanding of the ways in which every scientific breakthrough foreshadows the future, and precisely how critical the protection of intellectual property has become.
We bring to the table considerable industry experience on top of scientific expertise in biology, biochemistry, chemistry and chemical engineering. We also provide the depth of understanding that comes from working in a robust group that offers the full menu of IP services, from trials and appeals to patent prosecution and asset maximization strategies. In this extremely competitive industry, we are routinely involved in protecting clients' assets through litigation before the International Trade Commission, U.S. District Courts and Courts of Appeal. We advise clients on complex questions of patentability, validity and enforceability, as well as negotiate and vigorously enforce licensing agreements.
In addition, we have an active consumer focus, writing and prosecuting patents for small companies to multinational corporations that manufacture products such as aerosol shaving cream, ceramics, cleaning fluids, cookies, fabric softeners, nylon fabrics, photo technology, plastics, shampoo and toothpaste.
In a notable defense win, we represented W.L. Gore & Associates before the Federal Circuit and prevented Colgate's attempt to use its patents to stop Gore's manufacture and sale of Glide dental floss. Colgate had sued Gore for infringement of two patents purported to cover this very successful product. We obtained summary judgment regarding one of the patents and succeeded in having the other stayed while the re-examination request was before the U.S. Patent and Trademark Office. The Federal Circuit affirmed the PTO determination that relevant claims of the second Colgate patent were invalid based on the art and arguments we presented.
