MORGAN & FINNEGAN VICTORIOUS IN DISMISSING CLAYTON ACT ANTITRUST CLAIMS AGAINST CLIENT HEIDELBERGER DRUCKMASCHINEN AG (DISTRICT COURT OF NEW HAMPSHIRE, 2005)

On Nov. 9, 2005, U.S. District Judge Steven J. McAuliffe of the District of New Hampshire dismissed MAN Roland Druckmaschinen AG's Clayton Act antitrust claim against Morgan & Finnegan's client Heidelberger Druckmaschinen AG, alleging an illegal merger as a result of the sale of Heidelberger Druckmaschinen AG's web printing press business to Goss International Americas Inc. In dismissing the claim, the Court said, "Because MAN Roland has alleged no conduct by Heidelberger AG that violates Section 7, Heidelberger AG is entitled to dismissal of MAN Roland's sixth counterclaim."
